A Pembroke woman facing her second OUI charge was granted a motion to suppress evidence last week in Plymouth District Court. According to her motion, police failed to offer her a breathalyzer test after she was transported to the Hanson station because the Pembroke machine was broken.

Susan Belanger, 50, of Captain North Way was arrested at her home on Sept. 1 for OUI second offense, negligent operation and marked lanes violation. According to reports, state police as well as Duxbury, Kingston and Pembroke police received calls about a Ford Explorer that was driving erratically, weaving in and out of its lane and drove onto someone’s lawn at one point.

Police followed Belanger, who was operating a Ford Explorer matching the description, to her driveway where they confronted her, according to reports. She allegedly told police that a man driving behind her had made her nervous and that she had had a glass of wine earlier.

After her arrest, Belanger was taken to the Pembroke station where she requested a breathalyzer test but was told the machine was broken. She was transported to Hanson but was not given the opportunity to take the test there, either, according to her statement.

Belanger’s motion asserted that officers’ failure to issue the test had violated her rights. On May 7, a judge ruled in favor of her motion, suppressing evidence observed by police after her arrest, though any observations made prior to the arrest are admissible.
